The European Commission's proposal for a General Data Protection Regulation represents the most significant global development in data protection law in the last twenty years. As the trilogue negotiations come to a close and the final shape of the Regulation becomes clear it is time to take stock of what this means for your business and ensure you have the budget, tools and plan in place to respond.

It is clear that the new Regulation will significantly change the landscape of EU privacy and data protection in several key areas, including: substantial new penalties of up to €100 million, or 2-5% of annual worldwide turnover, whichever is greater; increased territorial scope, capturing many businesses including many outside the EU; tighter requirements for obtaining valid consent to the processing of personal data; new restrictions on profiling and targeted advertising; new data breach reporting obligations; direct legal compliance obligations for “data processors;” and extended data protection rights for individuals, including the “right to be forgotten.”

Andrea Glorioso (Mr) is the Counselor for the Digital Economy at the Delegation of the European Union to the USA, in Washington DC. In this role, he acts as the liaison between the EU and US on policy, regulation and research activities related to the Internet and Information and Communication Technologies. Mr Glorioso worked for eight years at the European Commission in Brussels (Belgium) on cyber-security, personal data protection, cloud computing and Internet governance. He was part of the team that produced the European Commission’s 2009 Action Plan on the Internet of Things.
